That worry is not unfounded. NRI property disputes in India are more common than most people realise. And what makes it worse is that many of these disputes could have been avoided with a few simple steps taken early on.

Why NRIs Are Easy Targets

Let us be honest about this. Distance is a vulnerability. When you are not physically present, family members, tenants, or even neighbours can take advantage of the situation. Indian property laws can be complicated. Paperwork gets delayed. And without someone trustworthy on the ground, things can go wrong quietly — until one day they go very wrong.

Problem #1: Someone Else Is Claiming Your Property

This is more common than you think. A distant relative, a neighbour encroaching on your boundary, or even someone forging documents — unauthorised occupation happens, especially when property has been sitting idle for years.

What to do: Do not leave your property unoccupied without a clear arrangement. If you are not renting it out, at least have a trusted local contact who physically visits it regularly. If you suspect encroachment, get a legal notice issued immediately. Delay only strengthens the other party’s position.

Problem #2: A Power of Attorney That Went Wrong

Many NRIs give Power of Attorney (POA) to a family member or known person to manage their property. This can work beautifully — or become a nightmare. There are documented cases where POA holders have sold property without the owner’s knowledge or rented it out and pocketed the rent.

What to do: Never give a general, unlimited POA. A limited POA that specifies exactly what the person can and cannot do is far safer. Have it drafted by a qualified NRI property lawyer, not just anyone. And review it regularly — revoke and reissue if your circumstances change.

Problem #3: Inheritance Disputes After a Parent Passes Away

This is emotionally the hardest one. A parent passes, and suddenly there is a dispute over who gets what. If there is no Will, Indian succession laws apply — and they do not always divide things the way your family assumed they would.

What to do: Encourage your parents to write a registered Will while they are well and able to. If a dispute has already started, get a lawyer involved early. Do not wait hoping the family will sort it out. These disputes rarely resolve themselves.

Problem #4: A Tenant Who Will Not Leave

You rented out your flat to someone. Years passed. Now they will not vacate, they have stopped paying rent, and they are claiming tenant rights. This is a nightmare situation that affects many NRI landlords across India.

What to do: Always use a registered rent agreement with a clearly defined tenure. The agreement must be renewed if you want to continue the tenancy. Under the Model Tenancy Act, landlords have clearer rights now — but only if the paperwork is in order from day one.

Problem #5: Property Fraud Through Forged Documents

Yes, this happens. Fraudsters create forged sale deeds or mutation entries and claim ownership of property that belongs to you. If you have not checked your property records in years, you may not even know.

What to do: Periodically check your property records online through your state’s land records portal. Many states now allow this. If you notice anything suspicious — a name you do not recognise, a transaction you did not authorise — contact a property lawyer immediately and file a police complaint.
